1. Acceptance of Terms
By accessing or using InstaGroups (the "Service"), operated by ConnectedPE Pty Ltd ("we", "our", "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. Description of Service
InstaGroups is a team generation and management tool designed for physical education teachers, coaches, and educators. The Service allows you to create class groups, generate balanced teams, run tournaments, and collaborate with colleagues.
3. Account Registration
To use certain features, you must create an account. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account.
4. Free and Pro Plans
Free Plan
The free plan includes up to 2 class groups and 30 students. Core features including team generation, tournament draws, and presentation mode are available on the free plan.
Pro Plan
The Pro plan provides unlimited class groups, unlimited students, collaborative workspaces, and priority support. Pro subscriptions are billed through Apple's App Store or via our website and are subject to the respective platform's terms.
5. Subscriptions and Billing
- Pro subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
- You can manage and cancel your subscription through your Apple ID account settings or the platform where you subscribed
- Refunds are handled according to Apple's App Store refund policy
- We reserve the right to change pricing with reasonable notice
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload malicious content or attempt to compromise the Service
- Share your account credentials with others
- Use automated tools to scrape or extract data from the Service
- Misrepresent your identity or affiliation
- Interfere with or disrupt the Service
7. Your Data
You retain ownership of all data you enter into the Service, including student information, class groups, and team configurations. We do not claim any intellectual property rights over your data.
You are responsible for ensuring you have appropriate consent and authority to enter any personal data, including student data, in compliance with applicable data protection laws and your institution's policies.
8. Workspace Collaboration
When you invite colleagues to your workspace, you grant them read access to your class groups, team sessions, and draws. You are responsible for managing workspace membership and can remove members at any time.
9. Intellectual Property
The Service, including its design, features, algorithms, and content (excluding your data), is owned by ConnectedPE Pty Ltd and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, ConnectedPE Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
12. Termination
We may suspend or terminate your access to the Service at our discretion if you violate these Terms. You may delete your account at any time through the app settings. Upon termination, your data will be permanently deleted.
13. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page. Continued use of the Service after changes constitutes acceptance.
14. Governing Law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms shall be resolved in the courts of Victoria, Australia.
