Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the InstaGroups mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App. These Terms constitute a legally binding agreement between you and InstaGroups ("we," "us," or "our").

2. Description of Service

InstaGroups is a mobile application designed for educators, coaches, and group leaders to:

• Create and manage student or participant groups
• Generate balanced teams based on gender, ability, and other criteria
• Create and manage round robin and knockout tournament draws
• Track scores and standings for competitions
• Share workspaces collaboratively with other users

3. Account Registration

To access certain features of the App, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

4. Subscriptions and Payments

4.1 Free and Pro Tiers

InstaGroups offers both free and paid subscription tiers. The free tier provides basic functionality, while the Pro subscription unlocks additional features including unlimited groups, advanced balancing options, tournament management, and workspace collaboration.

4.2 Billing

Pro subscriptions are billed through the Apple App Store or Google Play Store, depending on your device. By subscribing, you authorize the applicable app store to charge your chosen payment method. Subscription fees are charged in advance on a monthly or annual basis.

4.3 Cancellation

You may cancel your subscription at any time. To cancel, you must manage your subscription through your device's app store:

Cancellation will take effect at the end of your current billing period. You will continue to have access to Pro features until then. We cannot process refunds directly; all refund requests must be submitted through the Apple App Store or Google Play Store.

4.4 Price Changes

We reserve the right to change subscription prices. Any price changes will be communicated in advance and will apply to subsequent billing periods. Continued use of the Pro subscription after a price change constitutes acceptance of the new price.

5. User Content and Data

You retain ownership of all data you input into the App, including student names, group configurations, and tournament data ("User Content"). By using the App, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the service.

You are solely responsible for the accuracy and legality of your User Content. You represent that you have obtained all necessary consents to input personal information about students or other individuals into the App.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Input false, misleading, or inappropriate content
• Attempt to gain unauthorized access to other users' accounts or data
• Interfere with or disrupt the App's servers or networks
• Reverse engineer, decompile, or disassemble the App
• Use the App to collect personal information without proper consent
• Share your account credentials with others or allow multiple people to use a single account

7. Workspace Collaboration

The App allows you to share workspaces with other users. When you share a workspace, you grant the invited users access to view and edit the data within that workspace. You are responsible for managing access permissions and ensuring that you only share data with authorized individuals. We are not responsible for how collaborators use shared data.

8. Intellectual Property

The App and its original content, features, and functionality are owned by InstaGroups and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the App without our prior written consent.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YOUR USE OF THE APP IS AT YOUR SOLE RISK.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INSTAGROUPS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

11. Indemnification

You agree to indemnify and hold harmless InstaGroups and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App, your violation of these Terms, or your violation of any rights of another.

12. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the App will immediately cease. You may also delete your account at any time through the App's settings.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which InstaGroups operates, without regard to its conflict of law provisions.
